BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:

* Section 1. AS 05.35.100(a) is amended to read:

(a) There is created in the general fund an Alaska Winter Olympics account. The Department of Revenue shall prepare the permanent fund dividend application to allow applicants to designate that $10 [$5] of the dividend be subtracted from their check and contributed to the Alaska Winter Olympics account. Permanent fund dividend contributions shall be deposited in the Alaska Winter Olympics account. The Department of Revenue may use money in the Alaska Winter Olympics account to pay administrative costs incurred under this section.

* Sec. 2. This Act takes effect immediately under AS 01.10.070(c).

Relating to the minting and sale of commemorative gold and silver medallions; and providing for an effective date.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:

* Section 1. AS 44.09 is amended by adding a new section to read:

Sec. 44.09.017. COMMEMORATIVE GOLD AND SILVER MEDALLIONS. (a) The Department of Administration shall contract or otherwise arrange for the minting and sale of Alaska commemorative medallions minted only from .999 fine gold and silver in weights determined by the commissioner of administration. Gold and silver mined in Alaska shall be used in the production of the medallions. The state shall receive a royalty from the sale of the medallions. The amount of the royalty shall be determined by the commissioner of administration.

(b) One side of the commemorative medallions minted under this section shall contain the state seal. The design for the other side shall be determined in an annual contest conducted by the contractor under the supervision of the Department of Administration. Only designs using an Alaska theme and submitted by an Alaska resident may be considered in the contest. Payment for the winning design may not exceed $1,000.

(c) No later than January 20 of each year, the contractor shall submit to the legislature a report on the production and sale of medallions under this section.

* Sec. 2. This Act takes effect immediately under AS 01.10.070(c).

Relating to the disposal of property forfeited under federal drug enforcement laws.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:

* Section 1. AS 17.30.100 is amended by adding a new subsection to read:

(d) The Department of Public Safety or a local law enforcement agency may accept from the United States Attorney General property, including money, that is forfeited under 21 U.S.C. 881 (the Controlled Substances Act). The Department of Public Safety and local law enforcement agencies shall, in accordance with 21 U.S.C. 881(e) and regulations and policies adopted under that section, use property and the proceeds of property obtained under this subsection in the enforcement of this chapter, AS 11.71, and municipal ordinances substantially similar to this chapter and AS 11.71.

* Sec. 2. This Act is retroactive to January 1, 1985.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:

* Section 1. AS 12.45.120 is amended to read:

Sec. 12.45.120. AUTHORITY TO COMPROMISE MISDEMEANORS FOR WHICH VICTIM HAS CIVIL ACTION. If [WHEN] a defendant is held to answer on a charge of misdemeanor for which the person injured by the act constituting the crime has a remedy by a civil action, the crime may be compromised except when it was committed

(1) by or upon a peace officer, judge, or magistrate while in the execution of the duties of that office;

(2) riotously;

(3) with an intent to commit a felony;

(4) larcenously;

(5) against

(A) a spouse or a former spouse of the

defendant;

(B) a parent, grandparent, child, or grandchild

of the defendant;

(C) a member of the social unit comprised of

those living together in the same dwelling as the

defendant; or

(D) a person who is not a spouse or former

spouse of the defendant but who previously lived in a

spousal relationship with the defendant.

Relating to the office of public advocacy and volunteer

guardians ad litem.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:

* Section 1. AS 44.21.410 is amended to read:

Sec. 44.21.410. POWERS AND DUTIES [OF PUBLIC ADVOCACY OFFICE]. (a) The office of public advocacy shall

(1) perform the duties of the public guardian under AS 13.26.360 - 13.26.410;

(2) provide visitors and experts in guardianship proceedings under AS 13.26.131;

(3) provide guardian ad litem services to children in child protection actions under AS 47.17.030(e) and to wards and respondents in guardianship proceedings who will suffer financial hardship or become dependent upon a government agency or a private person or agency if the services are not provided at state expense under AS 13.26.112;

(4) provide legal representation in guardianship proceedings to respondents who are financially unable to employ attorneys under AS 13.26.106(b), to indigent parties in cases involving child custody in which the opposing party is represented by counsel provided by a public agency, and to indigent parents or guardians of a minor respondent in a commitment proceeding concerning the minor under AS 47.30.775;

(5) provide legal representation and guardian ad litem services under AS 25.24.310; in cases arising under the Uniform Interstate Compact on Juveniles (AS 47.15); in cases involving petitions to adopt a minor under AS 25.23.125(b); in cases involving petitions to remove the disabilities of a minor under AS 09.55.590; in children's proceedings under AS 47.10.050(a); and in cases involving indigent persons who are entitled to representation under AS 18.85.100 and who cannot be represented by the public defender agency because of a conflict of interests;

(6) develop and coordinate a program to recruit, select, train, assign, and supervise volunteer guardians ad litem from local communities to aid in delivering services in cases in which the office of public advocacy is appointed as guardian ad litem.

(b) The commissioner of administration may

(1) adopt regulations that the commissioner considers necessary to implement AS 44.21.400 - 44.21.440;

(2) report on the operation of the office of public advocacy when requested by the governor or legislature or when required by law;

(3) solicit and accept grants of funds from governments [THE FEDERAL GOVERNMENT] and from persons [PRIVATE FOUNDATIONS], and allocate or restrict the use of those funds as required by the grantor.

* Sec. 2. AS 44.21.410 is amended by adding a new subsection to read:

(c) The commissioner of administration shall separately account for money received under (b)(3) of this section and deposited in the general fund. The annual estimated balance in the account may be used by the legislature to make appropriations to the Department of Administration to carry out the purposes of this section.

* Sec. 3. AS 44.21 is amended by adding new sections to read:

Sec. 44.21.450. CIVIL LIABILITY OF VOLUNTEER GUARDIANS. (a) A volunteer guardian ad litem under the supervision of the office of public advocacy is not civilly liable for acts or omissions during the good faith performance of duties as a guardian unless the acts or omissions constitute gross negligence.

(b) This section does not affect the civil liability of the office of public advocacy.

Sec. 44.21.460. NONATTORNEY VOLUNTEER GUARDIANS AD LITEM. A nonattorney volunteer guardian ad litem may not give legal advice or act in the capacity of attorney for a minor before a court or administrative agency.

Sec. 44.21.490. DEFINITION. In AS 44.21.410 - 44.21.490, "volunteer guardian ad litem" means a court-appointed special advocate (CASA).

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:

* Section 1. AS 06.05.180 is amended to read:

Sec. 06.05.180. POWERS AS TRUSTEE AUTHORIZED. Every bank organized under this chapter, subject to the restrictions and limitations of laws and the regulations of the department, may

(1) act as trustee under any mortgage or bond issued by the state, or any municipality, body politic, or corporation, foreign or domestic, and accept and execute any municipal or corporate trust not prohibited by the laws of this state;

(2) accept a trust from, and execute a trust for a married woman in respect to the married woman's [HER] separate property, and act as agent in the management of the property or transact any busi-ness in relation to the property;

(3) act under the order or appointment of a court of competent jurisdiction including any probate court as guardian, receiver, or trustee of the estate of a minor, and as depository of money paid into court for the benefit of any person, corporation, or party, and in any other fiduciary capacity;

(4) act under the order or appointment of a court of competent jurisdiction including any probate court as trustee, guardian, receiver or committee of the estate of a lunatic, idiot, spendthrift, person of unsound mind or habitual drunkard, or as receiver or committee of the property or estate of any person in insolvency or bankruptcy proceedings;

(5) act as executor or administrator with or without the will annexed of the estate of a deceased person;

(6) accept and execute any legal trust, duty and power in regard to the holding, management and disposition of any estate, real or personal, wherever located, and the rents and profits from it, or the sale of it, as may be granted or confided to it by a court of competent jurisdiction including any probate court or by any person, corporation, municipality or other authority, and is accountable to all parties in interest for the faithful discharge of every trust, duty, or power which it may accept;

(7) accept and execute any trust or power conferred upon it by any person or any body politic or domestic or foreign corporation, or any other authority, grant, assignment, transfer, devise, bequest or otherwise, or which may be entrusted or committed or transferred to it by order of a court of competent jurisdiction including any probate court;

(8) receive, manage, hold and dispose of according to the terms of any trust or power any property or estate, real or personal, which may be the subject of any such trust or power;

(9) act as the fiscal or transfer agent of the United States or of any state, territory, municipality, or other body politic, and in this capacity may receive and disburse moneys, transfer, register and countersign certificates of stocks, bonds, or other evidences of indebtedness;

(10) whenever the instrument or power governing the fiduciary relationship directs, requires, authorizes, or permits investment in obligations of the United States government, invest in the obligations, for short-term cash management purposes, either directly or in the form of securities of, or other interests in, a money market mutual fund operating as an open-end management type investment company or investment trust registered under 15 U.S.C. 80a-1 - 80a-64 (Investment Company Act of 1940), if

(A) the portfolio of the investment company or

investment trust is limited to obligations of the United

States government and repurchase agreements fully

collateralized by the obligations; and

(B) the investment company or investment trust

takes delivery of the collateral directly or through an

authorized custodian.

* Sec. 2. AS 06.05.270(a) is amended to read:

(a) In addition to loans and acquisitions expressly authorized by this chapter, a state bank may deal in, underwrite, and invest in for its own account

(1) direct or guaranteed obligations of the United States, either directly or in the form of securities of, or other interests in, an open-end management type investment company or investment trust registered under 15 U.S.C. 80a-1 - 80a-64 (Investment Company Act of 1940), if

(A) the portfolio of the investment company or

investment trust is limited to obligations of the United

States government and repurchase agreements fully

collateralized by the obligations; and

(B) the investment company or investment trust

takes delivery of the collateral directly or through an

authorized custodian;

(2) general obligations of the State of Alaska and its political subdivisions;

(3) general obligations of a state of the United States or its political subdivisions;

(4) revenue obligations of the State of Alaska or its political subdivisions subject to the limitation of (b) of this section;

(5) revenue obligations of a state of the United States or its political subdivisions subject to the limitation of (b) of this section;

(6) obligations of instrumentalities of the United States government including, but not limited to Federal Intermediate Credit Banks, Federal Land Banks, the Federal National Mortgage Association, and Banks for Cooperatives;

(7) commercial paper of prime or equivalent quality as rated by a recognized national rating service subject to the limitation of (b) of this section;

(8) secured corporate obligations rated within the three highest grades of a national rating service subject to the limitation of (b) of this section;

(9) obligations of the International Bank for Reconstruction and Development, [OR] the Inter-American Development Bank, or the African Development Bank, subject to the limitation of (b) of this section;

(10) stock in the Federal National Mortgage Association or a Federal Reserve Bank.

(b) Except as provided in (d) of this section, the Department of Fish and Game and the Department of Natural Resources shall exercise their respective authorities over the Anchorage Coastal Wildlife Refuge consistent with a management plan prepared by the Department of Fish and Game in consultation with the Department of Natural Resources.

(c) A public right-of-way for surface transportation and a utility corridor are created across state-owned land and water within the Anchorage Coastal Wildlife Refuge between the Anchorage mainland and Fire Island. The management plan prepared under (b) of this section shall identify the actual location on the land and water of the right-of-way and of the utility corridor between the Anchorage mainland and Fire Island.

(d) Land owned by the Municipality of Anchorage that lies within the boundary of the Anchorage Coastal Wildlife Refuge described in (a) of this section may be included in the Anchorage Coastal Wildlife Refuge. An agreement between the Department of Fish and Game and the Municipality of Anchorage for the management of the land within the Anchorage Coastal Wildlife Refuge that is owned by the Municipality of Anchorage shall be approved by the Municipality of Anchorage and by the Department of Fish and Game.

(e) The state or the Municipality of Anchorage may not acquire privately owned land within the Anchorage Coastal Wildlife Refuge described in (a) of this section by eminent domain for inclusion within the Anchorage Coastal Wildlife Refuge. The Department of Fish and Game or the Municipality of Anchorage may acquire privately owned land within the Anchorage Coastal Wildlife Refuge by purchase, exchange, or otherwise, except by eminent domain.

(f) The land and water areas of the Anchorage Coastal Wildlife Refuge are closed to mineral entry under AS 38.05.185 - 38.05.275.

* Sec. 2. The initial management plan prepared under AS 16.20.031(b) as enacted in sec. 1 of this Act shall be completed within three years after the effective date of this Act.

* Sec. 3. AS 16.20.030(b) is repealed.

* Sec. 4. This Act takes effect immediately under AS 01.10.070(c).

Requiring certain motor vehicle insurance policies to provide reduced rates for certain persons; and providing for an effective date.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:

* Section 1. AS 21.89.020 is amended by adding new subsections to read:

(f) An insurer shall provide an appropriate reduction in the premium charged for a motor vehicle casualty insurance policy when the principal operator of the motor vehicle covered by the insurance policy

(1) is 55 years of age or older;

(2) requests the insurer to provide the reduction;

(3) provides the insurer with proof satisfactory to the director that the operator has within the three years before requesting the reduction taken and successfully completed a motor vehicle accident prevention course approved by the Department of Public Safety under AS 28.05.035; and

(4) did not take and complete the accident prevention course described in (3) of this subsection as a result of an order or sentence imposed by a court.

(g) An insurer may cancel a rate reduction provided under

(f) of this section if during the policy period the principal operator of the insured motor vehicle is

(1) involved in an accident caused by the operator; or

(2) convicted of a moving traffic violation.

(h) The reduced rate provided for an operator under (f) of this section may not extend beyond three years after the last day of the operator's most recently successfully completed motor vehicle accident prevention course described in (f)(3) of this section.

* Sec. 2. AS 28.05 is amended by adding a new section to read:

Sec. 28.05.035. COMMISSIONER MAY APPROVE ACCIDENT PREVENTION COURSES. For the purposes of AS 21.89.020(f)(3), the commissioner may approve driver education courses intended to prevent motor vehicle accidents and promote safe driving practices.

* Sec. 3. APPLICABILITY. This Act applies to policies of motor vehicle casualty insurance entered into or renewed on or after October 1, 1988.

* Sec. 4. This Act takes effect October 1, 1988.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:

* Section 1. AS 42.05.431 is amended by adding new subsections to read:

(c) Notwithstanding (b) of this section,

(1) a wholesale agreement for the sale of power from a project licensed by the Federal Energy Regulatory Commission on or before January 1, 1987, and related contracts for the wheeling, storage, regeneration, or wholesale repurchase of power purchased under the agreement, entered into between the Alaska Power Authority and one or more other public utilities or among the utilities after October 31, 1987, and before January 1, 1988, and amendments to the wholesale agreement or related contract, are not subject to review or approval by the commission until all long-term debt incurred for the project is retired; and

(2) a wholesale agreement or related contract described in (1) of this subsection may contain a covenant for the public utility to establish, charge, and collect rates sufficient to meet its obligations under the contract; the rate covenant is valid and enforceable.

(d) Meetings between the Alaska Power Authority and public utilities concerning a wholesale agreement for the sale of power or other matter exempted from review of the commission under (c) of this section must comply with AS 44.62.310.

* Sec. 2. AS 42.05.511 is amended by adding a new subsection to read:

(d) Validated costs incurred by a utility in connection with the related contracts described in AS 42.05.431(c)(1) must be allowed in the rates charged by the utility. In this subsection, "validated costs" are the actual costs that a utility uses, under the formula set out in related contracts described in AS 42.05.431(c), to establish rates, charges for services and rights, and the payment of charges for services and rights. This subsection does not grant the commission jurisdiction to alter or amend the formula set out in those related contracts.

* Sec. 3. AS 44.83.090(b) is amended to read:

(b) The authority is not subject to the jurisdiction of the Alaska Public Utilities Commission. Nothing in this chapter ]AS 44.83.010 - 44.83.425! grants the authority ]ANY! jurisdiction over the services or rates of a ]ANY! public utility or diminishes or otherwise alters the jurisdiction of the Alaska Public Utilities Commission with respect to a ]ANY! public utility, including any right the commission may have to review and approve or disapprove contracts for the purchase of electricity by a public utility other than wholesale agreements and contracts described in AS 42.05.431(c)(1).

* Sec. 4. AS 44.83.162 is amended by adding a new subsection to read:

(p) In calculating power cost equalization, the commission may not consider validated costs or kilowatt-hour sales associated with a United States Department of Defense facility.

* Sec. 5. This Act, except for AS 42.05.431(d), enacted by sec. 1 of this Act, is retroactive to November 1, 1987.

* Sec. 6. This Act takes effect immediately under AS 01.10.070(c).

This subsection does not apply to a person or motor vehicle exempted under regulations adopted by the commissioner. In this subsection "classroom studies" means curriculum studies that take place in a public school building.

An Act relating to the operation of state hatcheries; and providing for an effective date.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:

* Section 1. AS 16.10 is amended by adding a new section to article 8 to read:

Sec. 16.10.480. CONTRACTS FOR THE OPERATION OF STATE HATCHERIES.

(a) If the department determines that it is unable to continue operating a state-owned hatchery or that it is in the best interest of the state to provide for the operation of the hatchery by another person or by another person in cooperation with the state, the department may enter into a contract for the operation or cooperative operation of the hatchery.

(b) Notwithstanding AS 36.30, when selecting a contractor under (a) of this section, the department shall give a reference to the regional association organized under AS 16.10.380 that is locaated in the region in which the hatchery is located. If the department determines that the preferred regional association does not meet the criteria established by the department for the contract, the department may not award the contract to the preferred regional association and shall procure the contract under AS 36.30 after considering the recommendations of the preferred regional association.

(c) A contract entered into under this section must provide that the hatchery will be operated under AS 16.10.400 - 16.10.445 and 16.10.460 - 16.10.470 and the regulations adopted under those sections.

(d) The department may issue to a contractor who operates a hatchery under this section a permit to harvest adult salmon during the term of the contract in a quantity sufficient to allow the contractor to recover all or part of the contractor's costs of operating the hatchery.

(e) A contract under this section for the operation of a hatchery may not affect the state's ownership of the hatchery and does not affect the state's responsibility to manage the resource.

(f) The operation of a hatchery under a contract authorized by this section shall be conducted in accordance with the fisheries management and production goals of the department, and must be consistent with the Comprehensive Regional Salmon Plan approved under AS 16.10.375. During the term of the contract, the department may order changes in the operation of the hatchery that are necessary to ensure consistency with the production goals of the Comprehensive Regional Salmon Plan. The contract must specify the species to be raised and the production goals for each species, and these specifications must comply with the Comprehensive Regional Salmon Plan. The department may terminate a contract if the contractor fails to operate the hatchery in accordance with the requirements established by and under this subsection. * Sec. 2. AS 16.10.400(a) is amended to read:

(a) The commissioner or a designee may issue a permit, subject to the restrictions imposed by statute or regulation under AS 16.10.400 - 16.10.470, to a nonprofit corporation organized under AS 10.20, after the permit application has been reviewed by the regional planning team, for

(1) the construction and operation of a salmon hatchery;

(2) the operation of a hatchery under AS 16.10.480.

* Sec. 3. AS 16.10.400(b) is amended to read: (b) The application for a permit under this section shall be on a form prescribed by the department and be accompanied by an application fee of $100. The commissioner may waive the submission of an application for a permit to operate a hatchery under AS 16.10.480.

* Sec. 4. AS 16.10.400(e) is amended to read: (e) A qualified regional association formed under AS 16.10.380, if it has become a nonprofit corporation under AS 10.20, has a preference right to a permit under (a)(1) of this section if its proposed hatchery is provided for in the comprehensive plan for that region developed under AS 16.10.375 and the fresh water source exceeds one cubic foot per second minimum flow. Another ]ANY OTHER! local non-profit hatchery corporation approved by a qualified regional association has an identical preference right.

* Sec. 5. AS 16.10.410(c) is repealed and reenacted to read: (c) The hearing shall be conducted by the department. At a hearing for a permit under AS 16.10.400(a)(1), the applicant shall present a plan for the proposed hatchery, describing the capacity of the hatchery and other relevant facts that may be of interest to the department or the public. Interested members of the public shall be afforded an opportunity to be heard.

* Sec. 6. AS 16.10.450 is amended to read:

Sec. 16.10.450. SALE OF SALMON AND SALMON EGGS BY HATCHERY.

(a) Except as otherwise provided in a contract for the operat hatchery under AS 16.10.480, a ]A! hatchery operator who sells salmon returning from the natural waters of the state, or sells salmon eggs to another hatchery operating under AS 16.10.400 - 16.10.470, after utilizing the funds for reasonable operating costs, including debt retirement, expanding its facilities, salmon rehabilitation projects, fisheries research, or ]FOR! costs of operating the qualified regional association for the area in which the hatchery is located, shall expend the remaining funds on other fisheries activities of the qualified regional association.

(b) Fish returning to hatcheries and sold for human consumption shall be of comparable quality to fish harvested by commercial fisheries in the area ],! and shall be sold at prices commensurate with the current market. * Sec. 7. This Act takes effect immediately under AS 01.10.070(c).

* Section 1. LEGISLATIVE INTENT. The legislature finds that it is beneficial to support and promote the development of youth and winter sports within Alaska. In order to encourage the spirit of dedication and excellence in Alaskan athletes, this Act establishes the Alaska sports fund. It is the intent of the legislature to use the fund to encourage

(1) sports potential in Alaska youth;

(2) state, national, and international competitions; and

(3) development of training facilities in the state.

* Sec. 2. AS 05.35 is amended by adding a new section to read:

Sec. 05.35.150. ALASKA SPORTS FUND. There is established as a separate fund in the Department of Commerce and Economic Development the Alaska sports fund. The fund consists of private contributions and money appropriated to the fund from receipts under AS 28.10.165, 28.10.421(d)(14), and 28.10.421(f). Money in the fund may be appropriated for the promotion and development of sports.

* Sec. 3. This Act takes effect on the effective date of those sections of an Act enacted by the Fifteenth Alaska State Legislature that enact AS 28.10.165, 28.10.421(d)(14), and 28.10.421(f) providing for winter Olympics commemorative plates, or immediately under AS 01.10.070(c), whichever is later.

An Act relating to club licenses for the sale of alcoholic beverages; and providing for an effective date.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:

* Section 1. AS 04.11.110(b) is amended to read:

(b) A club license may only be issued to a club, fraternal organization, patriotic organization, or social organization that has been (1) chartered by a state or national organization for a period of two consecutive years before application for a license under this section; or (2) chartered by a national organization and the national organization has maintained a chartered club or organization within the state for a period of at least 20 years. The organization licensed under this section must be operated for social, recreational, political, benevolent or athletic purposes and not for profit. A club license may only be issued to an organization if none of the income from the sale of alcoholic beverages is distributed to its members, directors, or officers. Soliciting of public patronage of the club premises except as approved by the board is a violation of this section. * Sec. 2. AS 04.11.110(f) is amended to read:

(f) Alcoholic beverages purchased by a club or organization licensed under this section may not be used or consumed off the licensed premises of the club or organization by any person, including club members and employees unless used or consumed at social, recreational, benevolent or athletic functions of the club or organization and the use or consumption is approved by the board.

* Sec. 3. AS 04.11.400(a) is amended to read:

(a) Except as provided in (g), (h), (i), ]AND! (j), and

(k) of this section, a new license may not be issued and the board may prohibit relocation of an existing license

(1) outside an established village, incorporated city, unified municipality, or organized borough if after the issuance or relocation there would be more than one restaurant or eating place license for each 1,500 population or fraction of 1,500 population or more than one license of each other type, including licenses that have been issued under (g) or (h) of this section, for each 3,000 population or fraction of 3,000 population in a radius of five miles of the licensed premises or location of premises sought to be licensed, excluding the populations of established villages, incorporated cities, unified municipalities, and organized boroughs that are wholly or partly included within the radius;

(2) inside an established village, incorporated city, or unified municipality if after the issuance or relocation there would be inside the established village, incorporated city, or unified municipality more than one restaurant or eating place license for each 1,500 population or fraction of 1,500 population or more than one license of each other type, including licenses that have been issued under (g) or (h) of this section, for each 3,000 population or fraction of 3,000 population inside the established village, incorporated city, or unified municipality;

(3) inside an organized borough but outside an established village or incorporated city located within the borough, if after the issuance or relocation there would be inside the borough, but outside the established villages and incorporated cities located within the borough, more than one restaurant or eating place license for each 1,500 population or fraction of 1,500 population or more than one license of each other type, including licenses that have been issued under (g) or (h) of this section, for each 3,000 population or fraction of 3,000 population inside the borough, excluding the population of those established villages that have conducted an election on a question set out in AS 04.11.490, 04.11.496, or 04.11.500, and excluding the population of incorporated cities located within the organized borough.

* Sec. 4. AS 04.11.400 is amended by adding a new subsection to read:

(k) Except as provided in (i) of this section, within an incorporated city, unified municipality or an organized borough, a new club license may be issued, and the relocation of an existing club license may be approved by the board if

(1) the issuance or relocation of club licenses under the population limitation contained in (2) of this subsection has been approved by resolution adopted by the incorporated city, unified municipality, or organized borough within which the club license is to be issued or relocated; and

(2) after issuance or relocation there would not be, inside the incorporated city or unified municipality, or inside the organized borough but outside the incorporated cities located within the borough, more than one club license for each 1,500 population or fraction of 1,500 population.

(b) The Minto Flats State Game Refuge is established to

(1) ensure the protection and enhancement of

habitat;

(2) ensure the conservation of fish and wildlife;

and

(3) guarantee the continuation of hunting,

fishing, trapping and other uses by the public

compatible with the protection and

enhancement of habitat and the conservation of

fish and wildlife.

(c) The state may not acquire by eminent domain privately

owned land within the Minto Flats State Game Refuge,

but may acquire privately owned land by purchase,

exchange, or otherwise for inclusion in the Minto

Flats State Game Refuge.

(d) Management decisions under this section made by the

commissioner of natural resources and the

commissioner of fish and game are applicable only to

land and water described in (a) of this section.

(e) Public access to the Minto Flats State Game Refuge

by means of horse, boat, aircraft, dog team,

snowmachine, ATV, or other means consistent with

(b) of this section may not be prohibited.

(f) Access to and from private property within the

Minto Flats State Game Refuge shall be

guaranteed through access corridors established

through agreement between the Department of

Natural Resources, the Department of Fish and Game,

and the private property owners involved.

(g) The Department of Fish and Game and the

Department of Natural R Resources shall exercise their

respective authorities over the Minto Flats State

Game Refuge consistent with a management plan

prepared by the Department of Fish and Game in

consultation with the Department of Natural

Resources.

An Act establishing the Alaska children's trust fund to provide a continuing source of revenue for grants to community-based programs for the prevention of child abuse and neglect; and providing for an effective date.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:

* Section 1. AS 37.14 is amended by adding new sections to read:

ARTICLE 4. ALASKA CHILDREN'S TRUST FUND

Sec. 37.14.200. ALASKA CHILDREN'S TRUST FUND ESTABLISHED.

(a) The Alaska children's trust fund is established as a separate endowment trust fund of the state.

(b) The principal of the fund consists of

(1) legislative appropriations to the fund; and

(2) gifts, bequests, and contributions of cash or other assets from a person.

(c) The net income of the fund shall be determined by the commissioner of revenue in accordance with investment accounting principles and in a manner that preserves the distinction between principal and income.

Sec. 37.14.210. POWERS AND DUTIES OF THE COMMISSIONER OF REVENUE. The commissioner of revenue is the treasurer of the fund and has the following powers and duties under this section:

(1) to act as official custodian of the cash and investments belonging to the fund by securing adequate and safe custodial facilities;

(2) to receive all items of cash and investments belonging to the fund;

(3) to collect the principal and income from investments owned or acquired by the fund and deposit the amounts in separate principal and income accounts for the fund;

(4) to invest and reinvest the assets of the fund as provided in this section and as provided for the investment of surplus pension funds under AS 39.35.110(a),

(c), (e), (f), (h) and (i);

(5) to exercise the powers of an owner with respect to the assets of the fund;

(6) to do all acts, whether or not expressly authorized, that the commissioner of revenue considers necessary or proper in administering the assets of the fund;

(7) to maintain accounting records of the fund in accordance with investment accounting principles and with distinction between the principal and income accounts of the fund;

(8) to engage an independent firm of certified public accountants to annually audit the financial condition of the fund's investments and investment transactions;

(9) to enter into and enforce contracts or agreements considered necessary for the investment purposes of the fund;

(10) to report to the board the condition and investment performance of the fund.

Sec. 37.14.220. ALASKA CHILDREN'S TRUST FUND BOARD ESTABLISHED.

(a) The Alaska Children's Trust Fund Board is established in the Office of the Governor. The board is composed of

(1) the governor or a designee of the governor;

(2) the commissioner of health and social services or the commissioner's designee;

(3) a member of the Council on Domestic Violence and Sexual Assault elected by the council;

(4) the director of the office of public advocacy or the director's designee;

(5) the commissioner of education or the commissioner's designee;

(6) a member of the senate appointed by the president of the senate;

(7) a member of the house of representatives appointed by the speaker of the house of representatives; and

(8) three members appointed by the governor as follows:

(A) a licensed physician with a specialty in pediatrics who has practiced medicine in the state for at least five years and who is an expert in the subject of child abuse and neglect; and

(B) two public members, one of whom is a recognized expert in the subject of child abuse and neglect.

(b) The board shall elect a member to chair the board.

(c) The staff of the office of child advocacy serves as the staff of the board.

Sec. 37.14.230. POWERS AND DUTIES OF BOARD. The board shall

(1) hold regular meetings and special meetings it considers necessary; the board may hold meetings by teleconference;

(2) award grants from the net income of the fund to community-based programs and projects that the board finds will aid in the prevention of child abuse and neglect;

(3) monitor approved programs and projects for compliance with AS 37.14.200 - 37.14.270;

(4) before providing assistance to a program or project, approve written findings on the program or project that include a consideration of the means of measuring the effectiveness of the program or project;

(5) apply for, and use net income from the fund to obtain, private and federal grants for the prevention of child abuse and neglect;

(6) solicit contributions, gifts, and bequests to the fund;

(7) keep audio tape recordings of each meeting of the board to be made available on request; and

(8) submit to the governor and the legislature by February 1 each year a report describing

(A) the child abuse and neglect prevention services that were provided by the programs and projects to which the board awarded grants; and

(B) the annual level of contributions, income, and expenses of the fund.

Sec. 37.14.240. FUND UTILIZATION. (a) The principal of the fund and any capital gains or losses realized on the principal shall be retained perpetually in the fund for investment as specified in AS 37.14.210, and may not be used for the awarding of grants.

(b) The net income of the fund may be appropriated only for the following purposes:

(1) the awarding of grants;

(2) obtaining private and federal grants for the fund;

(3) soliciting contributions, gifts, and bequests for the fund; and

(4) reimbursement to the Department of Revenue for the costs of establishing the fund.

(c) Realized net income that has not been appropriated, or that has been appropriated but not expended, shall be invested until appropriated and expended.

Sec. 37.14.250. GRANTS. (a) In awarding grants from the net income of the fund, the board shall consider the proposals of a qualified applicant only after the applicant has submitted a detailed proposal in the form prescribed by the board. The board may not award a grant unless the board makes written findings that

(1) the proposed project, if successful, will help prevent child abuse or neglect;

(2) the application for financial assistance contains an adequate plan for project implementation, including both financial feasibility and project effectiveness;

(3) the applicant demonstrates that sufficient technical expertise is available to accomplish the objectives of the proposed program or project; and

(4) the applicant has identified costs associated with and ancillary to the project, additional governmental costs, future obligations generated by the program or project, and necessary operating, maintenance, or other support costs for the life of the program or project.

(b) The board may establish other requirements for the award of grants under this section if necessary to carry out the purpose of the fund.

(c) The board shall award grants in amounts that

(1) are appropriate to the conditions of the applicant and the proposed program or project; and

(2) will make the most effective use of the money available.

(d) The amount of all grants awarded by the board during a 12-month period to a single project or program may not exceed $50,000. The board may not finance more than 75 percent of the cost of a program or project during each of the first two years for which the program or project receives a grant, 50 percent during each of the third and fourth years, and 25 percent during each year thereafter.

(e) A recipient of a grant may not use more than 10 percent of the grant for administration of the program or project.

(f) To the extent consistent with the terms or conditions of the grant, a private or federal grant awarded to the board shall be distributed in the same manner as provided for grants under this section and AS 37.14.260.

Sec. 37.14.260. ELIGIBILITY FOR GRANTS. The board may award a grant to an applicant if

(1) the applicant has submitted a proposal that is acceptable to the board; and

(2) programs and projects ,if any, of the applicant that have previously received a grant from the board have complied with all requirements of that assistance and have performed with sufficient success or promise to warrant further financial assistance.

Sec. 37.14.270. DEFINITIONS. In AS 37.14.200 - 37.14.270

(1) "board" means the Alaska Children's Trust Fund Board;

(2) "child abuse and neglect" has the meaning given in AS 47.17.070;

(3) "fund" means the Alaska children's trust fund established under AS 37.14.200;

(4) "prevention of child abuse and neglect" includes primary and secondary prevention programs;

(5) "primary prevention program" means an educational or training program intended to raise the awareness of and change attitudes concerning child abuse and neglect and its prevention;

(6) "secondary prevention program" means a service intended to reach high-risk groups and to prevent the occurrence or recurrence of child abuse and neglect.

* Sec. 2. Notwithstanding the provisions of AS 37.14.230 and 37.14.240 as enacted by sec. 1 of this Act, until July 1, 1989, the Alaska Children's Trust Fund Board may use not more than $50,000 from the principal of the Alaska children's trust fund for the purposes specified in AS 37.14.- 240(b)(2) and (3) as enacted by sec. 1 of this Act.
